1. Acceptance of Terms
By accessing or using our services, you affirm that you have read, understood and agree to these Terms. If you do not agree, you may not use the Service.
2. Description of Services
Metierly provides website creation, CRM access, automation workflows, SMS and email messaging, appointment management, review generation, dashboard analytics and digital marketing tools. The platform infrastructure is provided through Go High Level.
3. Messaging Disclosure
When you opt into SMS communications, you authorize us to send appointment reminders, service alerts, account notifications, follow-up sequences, verification codes. Message frequency may vary. Standard message and data rates may apply.
Carriers are not liable for delayed or undelivered messages. You may unsubscribe from SMS at any time by replying STOP. For assistance, reply HELP.
Consent to receive SMS messages is not required to make a purchase.
4. A2P 10DLC Registration
By using our messaging services, you authorize Metierly to submit required business and campaign information to carriers and regulatory authorities for A2P 10DLC brand and campaign registration. This includes business details, sample messages and service descriptions.
5. User Responsibilities
You agree to use the platform responsibly and only send messages to contacts who have provided valid consent. You may not use the platform to send illegal, harmful, deceptive, threatening or unsolicited content. Violations may result in immediate suspension or termination of your account.
6. Subscriptions and Billing
Subscription fees are billed in advance and renew automatically unless cancelled before the next billing cycle. All payments are processed through Stripe. Because services involve immediate provisioning and customization, all payments are final and non-refundable.
7. Cancellation
You may cancel your subscription at any time by contacting support. Cancellation becomes effective at the next billing cycle. No refunds are provided for unused service periods.
8. Delivery of Services
Services are considered delivered once your website has been created, your CRM account has been activated or your automations and messaging tools have been configured. Onboarding is provided but not required for fulfillment.
9. Acceptable Use Policy
You may not use the Service to engage in spam, fraud, harassment, abuse, threats, malware distribution, deceptive practices or any communication sent without proper consent. Misuse may lead to account termination.
10. Limitation of Liability
Metierly is not responsible for lost profits, delays in message delivery, carrier failures, platform downtime, advertising performance, data loss or damages caused by user misuse. Our liability is limited to the amount paid in the 30 days preceding any claim.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the courts located in Delaware.
12. Changes to Terms
We may update these Terms at any time. Updates will be posted on our website, and your continued use of the Service constitutes acceptance of the updated Terms.
